Pumping iron, running, and working towards getting in better and better shape; that's why most people go to the gym. But Fruita's director of parks and recreation, Ture Nicom, says some folks have shown up for more than just a workout.

"We get all sorts of people visiting our facility,” he said. “We have had to ask some people not to return, I would say probably less than ten since we've been open."

The Fruita Rec Center is open seven days a week and was built to fulfill the needs of all in the community. But a particular incident involving a man photographing women couldn't be handled internally. The police had to be called in to help. 

"On the morning of the 15th of October, we assisted with a suspicious individual at the Rec Center," Fruita police sergeant John Coughran said.  

The man was using his cell phone to capture pictures and videos of women at the Rec Center working out. But the Fruita Police Department says the man wasn't committing a crime. 

“In order to be arrested for a crime, you have to commit one,” Coughran said. “The behavior, while it was suspicious and alarming, it didn't rise to the level of criminal behavior."

Officers say because the Rec Center is a public place, pictures and videos are allowed to be taken. That's how KJCT was able to obtain video. But because of the way the man was going about getting them, it had people concerned.

The Rec Center decided it wasn't the right place for him.  

“From our perspective, patron safety, patron comfort is priority for us,” Nicom said. “We do anything and everything we can to make sure our patrons are safe, feel comfortable here and feel like it's a safe place to come play basketball, swim, workout whatever they want to do."
