A local man convicted in the death of his 23-month-old stepson may receive a new trial thanks to a Colorado Court of Appeals decision.
The court decided Thursday morning that jurors received incorrect instructions before returning the guilty verdict against 24-year-old Brandon Moore in 2008, and has ordered a new trial.
Moore had been sentenced to life in prison in the 2007 death of young Logan Accord in Clifton.
His public defender claimed Moore had been suffering a panic attack during the time he repeatedly hit the child.
The court did rule a concurrent 48-year sentence on a separate child abuse charge will be allowed to stand.
