Investigation of tragedy near Powderhorn raises questions

GRAND JUNCTION, Colo. -

The investigation into the death of a young boy and serious condition of his brother remains shrouded in mystery tonight.

An affidavit detailing the incident was sealed just minutes after being signed.

Sheriff's officials aren't giving us much new information tonight, but they did say this death investigation could turn criminal.

The Sheriffs office couldn't comment on the condition of the surviving child, 4 year-old Tyler, sent to children's hospital in Denver.

The associated press says the children had been in the car at Powderhorn for a lengthy amount of time, leaving some to wonder if that act would be considered child abuse.

The 24 year old palisade mother, Heather Jensen, told investigators she left her two toddler sons alone in an SUV with the engine running before they were found.    

"It may, it may be, it may not be, but just because it is, or if they determine that that's the case, doesn't mean someone automatically is arrested for that right now... that could come," said Sheriff’s Department PIO, Heather Benjamin.

Any possible abuse charges are dependent on interview and autopsy results.

Child protective services haven’t gotten involved at this point.

No arrest warrants have been issued or suspects named.
