Dazed and confused about Amendment 64

Officials say more answers regarding 64 are anticipated once that December certification date passes.

There's no doubt about it, amendment 64 is creating a cloud of confusion on multiple levels.

Mesa County District Attorney, Pete Hautzinger said, "It may no longer be against the law of Colorado come December, but it's still against the law of United States of America."

Attorney Andrew Peters said, "Even though amendment 64 directs the state authorities not to charge someone, the federal government can and I anticipate probably will."

To add to the confusion, even though 64 passed in Colorado, it's not legal until it's certified by the secretary of state, which should happen by December 3rd.

Today Boulder district attorney, Stan Garnett said his district will start dismissing all pending charges for those 21 or older caught with less than an ounce of weed.

Here in Grand Junction however, that's not the case.

"Anybody who was arrested and charged prior to the election, and anybody who's arrested between now and the certification of the vote is still going to be prosecuted."

Hautzinger adds, "Wait for the Secretary of State to say it's the law."
