GRAND JUNCTION, Colo. (KKCO) A jury trial for Heather Jensen was scheduled to start next week, but according to the grandfather of the Jensen boys, it's been pushed back to January of 2014.
Robert Mathena, the paternal grandfather of Tyler and William Jensen, tells KKCO 11 News he was unexpectedly called into court late Tuesday afternoon and learned of the developments. He says the trial has been moved back, and is now scheduled on January 21, 2014. Mathena says the delay is because of a motion denied by the judge. Colorado court records haven't been updated to reflect the change, they still have the trial scheduled to begin on Monday.
Mathena talked to KKCO 11 News on Monday about the pressure and anxiety he's been feeling leading up to the trial, he and his wife were ready for the trial so they can move on and put the events behind them. He calls the decision to move the trial back 'heartbreaking' because there is yet another delay. The Mathena's already battled in court for the possession of their grandsons' bodies.
Heather Jensen was charged with 5 felonies and a misdemeanor charge of false reporting after the death of her two sons last November. Authorities allege she left them in a running vehicle up on the Mesa. The heat was left on in her vehicle, causing the boys to overheat. The coroner ruled the cause of death hyperthermia.
Jensen has pleaded not guilty to all the charges, including two counts of Child Abuse and two counts of Criminally Negligent Homicide.
