DA: We're going to fight the judge's decision

GRAND JUNCTION (KJCT) - The Mesa County DA's Office filed an appeal with the State Courts of Appeals on Friday, after a judge dropped 7 felony charges including murder-1 with extreme indifference, against 24-year-old Logan Lage who allegedly led state troopers on a high speed chase and crashed into a pregnant woman's SUV. 

In a big turn Thursday, a judge ruled that a baby 8 1/2 months along inside a mother's womb is not a "person" under state murder laws.  The crash happened November 6 on Highway 65.

It left 26-year-old Shea Lehnen injured-- and her unborn child died about an hour after being born alive that day. Lage is still facing charges including 1st degree assault-- and driving under the influence.

The Assistant DA said that the office will fight the judge's decision all the way to the State Supreme Court if they have to.

She recalled only one other case in Colorado history where a a murder charge was brought up against a man who was suspected of killing a woman along with her unborn child, that charge was also dismissed by a judge.

If this case does go to the Court of Appeals Mesa County might not have jurisdiction to reduce Lage's bond.

On Wednesday the 26th, Lage will be back in court and the judge will decide if he can change the bond in his case.
